He could have killed anybody.”</p><p>Both businesses were reportedly back open Sunday evening, as repairs were already underway on Café Mystique's front exterior wall. Castro Indian Restaurant and Bar's parklet was also being rebuilt Sunday. </p><p>San Francisco Police officers are searching for the suspect, and his car was impounded as part of the investigation. </p><p>“This is a busy time, usually, [when] nightlife is closing down,” Lt. Police responded to the crash around 8:29 pm, <a href="https://www.sfgate.com/local/article/sf-cable-car-crash-22210617.php">as SFGate reports</a>. </p><p>An SFPD spokesperson told the outlet that a 47-year-old male driver entered the restricted area of the cable car turnaround and caused damage to the turnaround signal and a protective concrete barrier, but no injuries were reported. </p><p>The suspect reportedly fled on foot and was detained by SFPD officers near Cyril Magnin and Ellis streets. He was booked into San Francisco County Jail on suspicion of driving under the influence, hit and run, and unlawfully disobeying a traffic sign. </p><div align="center" style="width:100%; max-width:100%">

Police determined the driver was allegedly under the influence of alcohol.</p><p>All five teens were transported to the hospital, where one was declared dead, and the others were reportedly in serous and critical condition. </p><p>The police department said based on preliminary information, it’s not believed they’re from Novato. </p><p>“We understand that this is an incredibly difficult situation for all the families involved as they navigate the weight of this tragedy,” wrote the police department.</p><p>This incident is still under investigation. CHP said the driver of a southbound Mitsubishi crashed head-on into a northbound Toyota sedan after side-swiping another vehicle, as <a href="https://www.nbcbayarea.com/news/local/napa-county-crash-2-dead-2-injured/4059810/">NBC Bay Area reports</a>. </p><p>Authorities are calling the crash a "mass casualty event," as victims had to be rushed to different hospitals for treatment.</p><p>One passenger in the Mitsubishi was pronounced dead at the scene, and another died at the hospital. It's unclear whether the faulty kits were used in other California counties.</p><p>Assistant District Attorney Brian Staebell told the Chronicle that a state-run lab in Santa Rosa, the Bureau of Forensic Services, provided a list of 14 tests that were conducted using defective kits from supplier Andwin Scientific, though five were tied to investigations that did not result in charges. Most of the nine convictions using the faulty tests were primarily DUI cases. Per the Chronicle, prosecutors said they notified defense attorneys this week after identifying the affected convictions.</p><p>The faulty test kits reportedly contained an incorrect concentration of sodium fluoride, about 100 milligrams instead of the stated 750 milligrams, as the Chronicle reports. This could allow yeast and sugar to ferment, potentially producing inaccurate alcohol readings and “may result in an artificially elevated alcohol level in the sample,” said lab director Katina Repp in a January 28 letter. </p><p>Repp said inaccurate alcohol readings would likely occur only in samples with enough sugar and yeast to trigger fermentation, which can happen in people with certain health conditions or infections, as the Chronicle reports. Though oddly, he was released from jail.  </p><p>Last March 7 at around 10 pm in Hayward, there was <a href="https://www.mercurynews.com/2025/03/10/three-car-rollover-crash-in-east-bay-kills-woman-critically-injures-another/">three-car rollover crash caused by a suspected DUI driver</a>, who police say was driving 88 miles per hour on Hayward Boulevard, and with a blood alcohol content of .23, about triple the legal limit. Though curiously, the accused DUI driver Hernandez-Benitez has remained a free man for most of the last nine months. </p><p>“He was arrested after the crash but then released from jail, records show,” the Bay Area News Group reports. “He is not in custody and has not yet had his first court appearance, according to public records. After all, that bad decision might end up leading to some escalatingly even worse bad decisions. </p><p>Consider that last Saturday, not long after 6 pm, a 63-year-old Oakland man parked his blue Audi A4 at Contra Costa County Fire Station 76 on Refugio Valley Road. He popped in just to ask for directions, though KRON4 reports that station personnel figured the <a href="https://www.kron4.com/news/bay-area/dui-driver-stopped-at-east-bay-fire-station-for-directions-police/">man who stopped to ask for directions was driving drunk</a>. According to a police report, this fellow “displayed the objective signs and symptoms of being under the influence of alcohol.”</p><p>Field sobriety tests and a breathalyzer confirmed this suspicion. Further review also confirmed the man’s license was suspended because of, you guessed it… a previous DUI.</p><p>The man was quickly arrested and booked in the Martinez Detention Facility. Upon being booked, officers also discovered baggies of suspected meth and fentanyl hidden in his sock.</p><p>Meanwhile, the man’s Audi A4 was towed from the fire station parking lot. McAlister was charged with DUI for allegedly having both alcohol and meth in his system at the time of the crash, and he tried to flee the scene on foot. As seen above, the British tabloid Daily Mail ran the headline “<a href="https://www.dailymail.co.uk/news/article-15166443/troy-mcalister-release-san-francisco-killed-women.html">Woke San Francisco judge set to grant early release to 91-time felon</a>.”</p><p>That headline is complete bullshit. The judge in question is <a href="https://sfist.com/2024/02/13/lets-consider-the-upcoming-sf-judge-elections-which-have-been-upended-by-pretend-report-cards/">SF Superior Court Judge Michael Begert</a>, but he was never “set to grant early release” to McAlister. McAlister’s public defender Scott Grant had merely asked for the diversion program instead of trial. And attorneys <em>always</em> ask for the best outcome for their client, it’s what attorneys do! The Chronicle reports that Begert <a href="https://www.sfchronicle.com/crime/article/troy-mcalister-diversion-court-judge-21123210.php">denied the request for diversion</a> Tuesday morning. So McAlister will indeed face trial on charges of DUI, vehicular manslaughter, driving a stolen car, possessing a concealed gun, and leaving the scene of a crash. </p><p>“Your actions, in combination with some incredibly bad luck, have resulted in two people losing their lives,” Begert said to McAlister during his Tuesday morning hearing. “I don’t know if you are ever going to be able to get over the fact that you are responsible for that. I think the way forward, as I see it, is for you to face your community through the criminal justice system and take accountability.”</p><p>The brass tacks of the legal argument that McAlister’s public defender requested was that Judge Begert “sever” the DUI charges, as DUI charges are not eligible for diversion. Begert declined to sever the DUI charges. </p><p>So McAlister’s case will go to trial, either late this year, or early next year. A Toyota Sienna minivan was traveling southbound on Pope Valley Road in unincorporated Napa County, 12 miles north of St. Helena, when it crashed into a tree on the side of the road. The minivan had eight men in it, including the driver, 53-year-old Norberto Celerino of Stockton. Six of the passengers were killed and one was critically injured.</p><p>Celerino, who did not have a valid driver's license, survived, and <a href="https://sfist.com/2025/09/10/alleged-drunk-driver-in-napa-crash-that-killed-six-people-had-three-previous-dui-convictions/">we learned a few days later</a> that he had three previous DUI convictions. He was also, allegedly, carrying three different driver's licenses, and authorities say that he also went by several names, including Beto Celerino Villalva, Grabien Martinez, and Roberto Savaringo-Diabla.</p><p>Celerino has now been charged with six counts of murder and six counts of gross vehicular manslaughter while intoxicated, as well as driving under the influence.</p><p>As <a href="https://www.ktvu.com/news/napa-county-crash-suspect-ice">KTVU reports</a>, ICE has identified him as 49-year-old Beto Cerillo-Bialva, and in a statement the agency calls him "a criminal alien from Mexico who first entered the United States in 1995."  They add that since he first came to the country, "he has been arrested several times for possession of cocaine, multiple DUIs, and removed multiple times from the United States."</p><p>The agency says further that "due to Cerillo['s] continued disregard for the laws within the United States and California’s sanctuary laws has led to this tragic incident."</p><p>The story has been picked up by Fox News, naturally, which refers to Cerillo-Bialva as "previously deported blue state driver."</p><p>The governor's office has shot back, turning the blame back in the direction of the Trump administration.</p><p>"It's clear that this is an attempt to distract from the truth," says Diana Crofts-Pelayo, deputy director of communications for Governor Newsom, in a statement. "This individual re-entered the country several times under the federal government's watch. Trump and Miller have little interest in public safety or protecting farmworkers."</p><p>Once this case goes to trial, it seems likely to incite more political grandstanding, much as in the tragic 2015 San Francisco shooting of Kate Steinle, on Pier 14. McAlister had also been arrested two months prior with burglary tools on him. Oh, and the car he was driving in the hit-and-run accident had been <a href="https://sfist.com/2021/01/04/parolee-accused-in-fatal-hit-and-run-allegedly-stole-car-in-daly-city-from-woman-he-was-on-a-date-with/">carjacked from a woman McAlister was on a date with</a> just two days earlier.  </p><p>McAlister was charged with DUI, vehicular manslaughter, driving a stolen car, possessing a concealed gun, and leaving the scene of a crash. The case is still making its way through the courts. But the Chronicle reports that McAlister's public defender is asking the court for a <a href="https://www.sfchronicle.com/crime/article/troy-mcalister-judge-mental-health-diversion-21073321.php">drug rehabilitation diversion program rather than jail</a>, a diversion program that would put him in <a href="https://sf.courts.ca.gov/divisions/collaborative-courts/drug-court">San Francisco Drug Court</a> that focuses on treatment and counseling instead of incarceration.</p><p>McAlister’s attorney, deputy public defender Scott Grant, told the Chronicle that a diversion program would be a “proper and reasonable” sentence, and added, “Research tells us again and again that intensive, targeted treatment for people’s underlying problems — not incarceration — fosters long-term safety.”</p><p>DA Brooke Jenkins’s office did not respond to the Chronicle’s request for comment on the matter. There’s also an additional angle that Jenkins has been accused of <a href="https://sfist.com/2025/05/16/retired-judge-totally-at-war-with-da-brooke-jenkins-files-appeal-in-her-ethics-judgement/">illegally sharing McAlister’s rap sheet</a> with a colleague as the Recall Boudin campaign was ramping up.  </p><p>The Chron notes that some tough-on-crime activists are planning a protest before Friday’s scheduled hearing on the matter at San Francisco Superior Court, though it’s highly unlikely that a decision will be made Friday. Specifically, KTVU is now reporting that the 53-year-old driver, Norberto Celerino of Stockton, <a href="https://www.ktvu.com/news/alleged-drunk-driver-napa-county-pope-valley-deadly-crash-prior-dui">had three previous DUI convictions</a>, and also did not have a valid driver’s license, and for whatever reason, also had three different aliases.   </p><p>Celerino had a previous DUI conviction in San Joaquin County in 2020, and then a second in the same county as recently as 2024. The third DUI conviction does not have date or location information attached to it, because the conviction is more than ten years old.  </p><p>Authorities in Napa County <a href="https://sfist.com/2025/09/09/its-been-five-years-since-orange-sky-day/">announced Monday</a> that they had arrested Celerino on suspicion of murder, which suggested that this would be a case of what's known as "<a href="https://www.shouselaw.com/ca/dui/laws/dui-murder/">Watson murder</a>" in California — a second-degree murder charge for a DUI death when a suspect has prior DUI convictions.</p><p>There were eight men in the minivan, including Celerino, and KTVU confirms they were all farm workers. Two have been identified as 42-year-old Loreto Ricardo Hernandez and 34-year-old Fernando Silverio. </p><p>The other six victims have not yet been identified, as police are still notifying next of kin. KTVU reports that the Napa County Sheriff's Office says that all eight men in the vehicle were likely from the Stockton area. And when they arrested him, police say Mendoza smelled of alcohol, was slurring his words, and had an open container of beer in his car.  </p><p>Now the Bay Area News Group reports that Mendoza <a href="https://www.eastbaytimes.com/2025/07/29/man-charged-with-murder-in-alcohol-related-hit-and-run-death-of-oakland-pedestrian/">is being charged with murder</a> by the Alameda County DA’s Office. He’s also being charged with DUI causing injury, driving with a .08% BAC or higher, leaving the scene of an accident, and gross vehicular manslaughter while intoxicated with a prior conviction.</p><p>And that “prior conviction” is actually two prior convictions. Per the Bay Area News Group, Mendoza had additional misdemeanor DUI convictions in both September 2012 and April 2013.
