The court ruled 3-0 yesterday that San Francisco's citywide ban on cigarette sales at drugstores was "flimsy on its face" given that they do not extend the ban to grocery stores that have pharmacies. </p>

<p>The Justices left open for a Superior Court judge to decide whether the city should just extend the ban to places like Safeway and Costco, or if it must be repealed altogether. Score one for the freedom to buy tobacco in the same place you buy your stain-fighting toothpaste and blood pressure meds. <p>Supervisor Eric Mar, who <a href="http://www.sfgate.com/cgi-bin/article.cgi?f=/c/a/2009/12/16/MNP01B4T3P.DTL">sponsored the cigarette hate</a>, says he's doing it to protect "San Francisco's most vulnerable residents from secondhand smoke." Which, we can only assume he's talking about kittens. Anyway, Mar's proposal would, <a href="http://sfappeal.com/alley/2009/12/more-smoking-bans-dont-bug-the-animals-potential-pay-cuts-for-muni-drivers-the-final-supes-meeting-o.php">according to reports</a>, "close 'huge loopholes in existing policy' and strengthen public health regulations by expanding the smoking ban in areas where people congregate. This means that lighting up be verboten at "farmers' markets, lines for movie theaters, concerts and sporting events, near ATMs and cab stands, and at the outdoor tables of restaurants." Everywhere, people. <em>Everywhere</em>.</p>

<p>That said, how do you feel about about not being able to smoke your <a href="http://financialshopva.com/images/more_red.jpg">Mores</a> while pulling out a $20?</p>

<p>Since many of you who smoke cigarettes -- dirty, filthy, rapey cigarettes that makes The Baby Jesus cry -- we know it's hard for you to always find a makeshift ashtray in which to trash them. Which is why most of you toss them on the street or out your car window. Now, however, Gavin Newsom,  <a href="http://sfist.com/2008/05/09/newsoms_makemeg.php">who hates smokie treats</a>, wants the cleanup cost of picking up said butts to fall on smokers' shoulders via a new a new citywide fee. The proposal, which will go before the Board of Supervisors next month, "<strong>would add 33 cents to the cost of a pack of cigarettes</strong>, to offset the estimated $10.7 million the city spends annually removing discarded butts from gutters, drainpipes and sidewalks," reports the <em><a href="http://www.nytimes.com/2009/05/19/us/19smoke.html?_r=1">New York Times</a></em>. What's more, according to Newsom, this added fee might (but probably not since addicts will find a way to get their fix) help smokers kick the habit. That is to say, you might have to look elsewhere to spark up that <a href="http://www.rsingh.net/gender/images/capri.gif">Capri</a> or <a href="http://www.euro-cig.com/gal_images/20060405161024.jpg">Virgina Slim</a> while eating out. The Board of Supervisors will vote on the measure come Thursday. </p>

<p>Oh, and <a href="http://sf.eater.com/archives/2008/07/16/smoked_out.php">we're also told</a> that this is the <strong>59th piece of restaurant-related legislation pushed in 2008</strong>.</p>

<p>Also, yes, it's commendable of Daly to introduce yet another ban on rich, smooth, satisfying <a href="http://www.scienceclarified.com/images/uesc_03_img0131.jpg">cigarettes</a>. It's great. And keeps us healthy. Or whatever. If it passes, cool; if not, <em>meh</em>. Are you as chock-full of chic insouciance when it comes to this proposed ban as well? Or do you demand to get your fix in between bites at <a href="http://www.orsonsf.com/">Orson</a>?
