The City Attorney's gone through all the residency documents that beleaguered Burlingame boy and erstwhile supposed San Francisco Supervisor Ed Jew provided last week, and ---- baaaaaaaaahmp -- (that's supposed to be a buzzer sound like when you guess something that's not on the board on Family Feud): the City Attorney has concluded that the documents currently on file are insufficient to demonstrate that Ed Jew lives in San Francisco. Oh no, Ed Jew!
Namely, of the documents that Tapioca Ed provided last week, the City Attorney did not receive: any tax returns from 2006, any phone bills from the SF residence, any cable bills from the SF residence, any information about magazine or newspaper subscriptions, or any information about the address for which the Jew family takes their homeowners' tax exemption. Hey, maybe Ed Jew 1) took an extension on his 2006 returns, 2) makes all calls on a cell phone, 3) reads the Chron online at work, and 4) got someone to tape the Sopranos finale for him last night!
The operative date by which Ed Jew is required to have lived in San Francisco is 30 days before filing to run for office, or July 12, 2006 (Jew filed on August 11, 2006. Can someone check our calendaring?) As for the operative date to prove up, Jew's got until Friday to give the City Attorney the rest of the documents and sit for an interview. As the deputy city attorney's letter sternly notes, "If your client is able to make statements to the press regarding the status of his residency, then we do not understand why he is unwilling to make statements on the record to this office." ABC 7 has a copy of the letter if you want to read it yourself.
Unrelated, but amusing: Leah Garchik points out that July 15 is National Tapioca Day. The 15th is also Respect Canada Day, for what it's worth.



If Ed Jew is found to not live in District 4, what exactly happens? Is he thrown out/removed from office by the City Attorney? Does the Mayor appoint a replacement? When does District 4 get to elect a new Supervisor? Thanks a bunch!
What's also great about that letter is that the Tapioca-Gruel team are also claiming that the FBI took their evidence.

Why verify residency before the election when you can always use it as a coup d'gras for a three way set up for those who veer off the reservation?
Corporate San Francisco is trying for a bold "end game" to off the pesky nature of participatory democracy.
Fucking with Jew gives Newsom a free shot. The City Attorney, Chronicle and probably entities sympathetic to both in the permitting subculture seem to have worked together quite effectively on this.
Recalling McGoldrick distracts progressives this fall if not costs us a seat, gives Newsom a second free shot.
Add to this the parking measure, and it seems like a coordinated strategy.

oh, and yes! While I'm editing my own comment, I can answer Megan's question too. Correct me if I'm wrong, but I think under City Charter 13.110(e), if they find that Ed Jew doesn't live in SF, he has to be removed from office. If a Supervisor is removed or resigns from office for any reason, Newsom gets to appoint the replacement under City Charter 13.101.5.

In the event of removal or resignation, the mayor appoints a replacement, but then there is a by-election at the next scheduled election (November 2007 in this case). This happened with Sean Elsbernd and Phil Ting.

Most of you probably don't know this, but there's a very old part of the City Charter that wasn't brought online. It still holds, however. It reads:
"Should a Board Supervisor be found with malfeasance to not properly reside thusly in his District, he will be henceforth catapulted from the Capitol Grounds in an eastwardly direction to-wards the Baye."
There's more in this part of Charter about how the Mayor is entitled to comely lasses as compensation, but that isn't relevant here. I believe the catapult is still in the City Hall basement.

Third, he signed a sworn statement on August 11 saying that he met residency requirements. So, perjury too??
